ARTICLE 2: ORDERS
Automatic recording systems are considered as proof of the nature and content of the order. Croix Précieuse confirms acceptance of the order to the customer at the email address provided by the customer. The sale will be concluded upon validation by Precious Cross of the payment of the order, i.e. the date of validation of the payment for orders paid online by bank card or the date of receipt of payment by check.
Precious Cross reserves in any event the right to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
ARTICLE 3: AVAILABILITY OF ARTICLES
As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of consultation of the site by the customer remains dependent on the state of the stock at Croix Précieuse and of course at the suppliers.
To create our showcase and our sales catalog, we work with databases, enriched according to the information communicated by our suppliers. This database contains more than a hundred articles, not all of them are stored in our reserves and our offer is then conditioned by the availability of the articles at the suppliers.
Only the definitive rupture of an item with our suppliers results in the removal of this item from our sales offer. In other cases, a new order within a certain period remains possible.
When there is unavailability of an ordered product, the customer is informed by email or on the invoice for the products shipped in the case of an order for several items.
Order delivery deadline: when placing the order and on the order acknowledgement, a delivery time is communicated to customers. It is calculated by adding the longest product availability time to the delivery time of the transport method selected by the customer.
From the moment the order is placed to its dispatch, the customer has the possibility of cancelling their order.

In any case, Precious Cross strives, from the final sale date, to ship items to customers who have reserved, up to the stock provided by the publisher for the release day.
ARTICLE 4: PRICE
The prices indicated in euros are deemed net, excluding shipping costs. This price includes the price of the products, the costs of handling, packaging and storage of the products.They can be modified at any time without notice, knowing that the items will be invoiced on the basis in force when the order is registered. All orders are invoiced in euros and payable in euros. Any customs fees or local taxes remain the responsibility of the recipient.
ARTICLE 5: SHIPPING COSTS
Shipping costs include a contribution to preparation, packaging and postage costs. Please consider grouping all your items into one order. We will not be able to group two separate orders and you will be charged shipping costs for each order.
ARTICLE 6: PAYMENT
You have several payment methods offering maximum security guarantees. You can pay:

7.1. Delivery methods
Precious Cross offers you two options for receiving your orders:

- Delivery to a relay point: to a collection point selected by the buyer at the time of purchase.

7.3. Delivery times
The delivery time includes:
- The time it takes to prepare your order: once the order has been validated, we carefully prepare your package for shipping.
- Delivery time by the carrier: this time varies depending on the destination and the delivery method chosen.
The overall delivery time announced is 5 to 15 working days, from the sending of the email confirming the shipment of your order.
7.4. Order tracking
You will be informed by email of the different stages of processing and delivery of your order:
- Confirmation of the preparation of your order.
- Confirmation of shipment of your package with tracking information.
7.5. Responsibilities related to deadlines
The delivery times announced (5 to 15 working days) are indicative and begin from the sending of the email confirming the shipment of the order.
If the agreed deadline is exceeded, you have the following rights:
- You may request us to deliver within a reasonable additional time by contacting us at contact@croix-precieuse.com.
- If delivery does not occur within this additional period, you can request cancellation of your order and a full refund.
In accordance with Article L.216-2 of the Consumer Code, if failure to meet delivery times is due to force majeure or exceptional circumstances (strike, natural disasters, etc.), Precious Cross may extend the delivery time or offer an alternative solution.
7.6. Delivery delays and incidents
In the event of a delay in delivery, we invite you to:

7.7. Delivery costs
Delivery costs are specified at the time of ordering, before validation and payment. They may vary depending on the destination and the delivery method selected.
7.8. Return policy in case of non-delivery
If a package could not be delivered for reasons beyond our control (incorrect address, prolonged absence, etc.), it will be returned to Precious Cross. The return shipping costs will be borne by the buyer, except in the case of an error attributable to our service.
ARTICLE 8: GUARANTEE - RETURNS - REFUNDS - WITHDRAWAL
8.1 Returns - Refunds - Withdrawal
Articles provided by https://croix-precieuse.com/ are new and guaranteed against any defect. They are identical to those of traditional commerce and come from all the referenced publishers and suppliers.
If an item is defective or non-compliant, the buyer has 15 working days from receipt of the items to request an exchange or refund. If the fifteen (15) day period normally expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
The customer must return new or unused items in their entirety, intact, accompanied by all possible accessories, instructions for use and documentation. (with the corresponding invoice and the return form provided by the After-Sales Service).
In the event of exercising the right of withdrawal, Croix Précieuse is required to reimburse the amounts paid by the customer, free of charge, with the exception of return costs. Reimbursement is due within a maximum of 14 working days from the date of receipt of the returned package(s).
The return shipping costs will then be your responsibility.
In case of refund, we guarantee that it will be made within 14 days or less following the date of receipt of the returned package. No cash on delivery shipments will be accepted, whatever the reason.
8.1.1 Applicable law and dispute resolution
These T&Cs are subject to French law.
In the event of any difficulty, Customer Service is at your disposal to find an amicable solution.
In the absence of a solution found directly with Customer Service, in accordance with the articles L.616-1 And R.616-1 of the consumer code, our company has set up a consumer mediation system. 8.2 Legal guarantees
The Company remains liable for any lack of conformity of the goods in accordance with the provisions of Articles L.217-4 et seq. of the Consumer Code as well as for any hidden defects in the item sold in accordance with Articles 1641 et seq. of the Civil Code.
When acting within the framework of the legal guarantee of conformity (as provided for by articles L.217-4 et seq. of the Consumer Code), the Consumer Client:
Benefits from a period of 2 years from delivery to act.
May choose between repair or replacement of the Product, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code
The requirement to provide proof of the existence of the lack of conformity is waived for 24 months following delivery of the goods if the Product is new, and for 6 months following delivery if the Product is sold second-hand.
The Customer may also decide to act under the legal guarantee against hidden defects within the meaning of Article 1641 of the Civil Code; the Customer may choose between cancellation of the sale or a reduction in the price, in accordance with Article 1644 of the Civil Code.
These legal guarantees apply independently of any contractual guarantee.

“In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods.However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate compared to the other method, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer.

ARTICLE 9: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS
The transfer of ownership of the products to the benefit of the purchaser will only be carried out after full payment of the price by the latter, regardless of the date of delivery of said products. On the other hand, the transfer of the risks of loss and deterioration of the products will only be carried out upon delivery and receipt of said products by the purchaser.
ARTICLE 10: PROTECTION OF YOUR PERSONAL DATA
Precious Cross is the producer and owner of all or part of the databases making up this site. By accessing this site, the customer acknowledges that the data making up the site are legally protected, and in particular undertakes not to extract, reuse, store, reproduce, represent or retain, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or part, qualitatively or quantitatively substantial, of the content of the databases appearing on the site to which he or she is accessing.

In the event of a dispute, the parties will endeavour to find an amicable solution before any legal action.In the absence of an amicable settlement, the dispute will be submitted to the competent courts in accordance with the rules of French law.
For consumers residing in the European Union, the mandatory consumer protection provisions of their national legislation also apply, in accordance with Regulation (EC) No 593/2008 of 17 June 2008 ("Rome I").
ARTICLE 13: ACCEPTANCE BY THE PURCHASER
These general terms and conditions of sale and the prices are expressly approved and accepted by the purchaser, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general terms and conditions of purchase, the act of purchase entailing acceptance of these general terms and conditions of sale.
